This policy, together with our Services Agreement, available at prequel.dev/terms/describes our practices related to collection, use, and disclosure of information we may collect from Customers and their Authorized Users who use our Service (collectively, “Users” or “you”), including:
- The types of information we may collect or that you may provide when you download, install, register with, access, or use our application monitoring and troubleshooting services through our cloud-based platform and downloadable software (the “Service”).
- Our practices for collecting, using, maintaining, protecting, and disclosing that information.
- Your rights and choices regarding the personal data we collect about you.
Capitalized terms that are not defined in this policy have the meaning assigned to them in our Services Agreement.
This policy applies to information we collect in the Service and, in email, text, and other electronic communications sent through or in connection with the Service.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Service. By downloading, registering with, or using the Service, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Service after we revise this policy means you accept those changes, so please check the policy periodically for updates.
The Service is not intended for children under 16 years of age, and we do not knowingly collect personal data from children under 16. If we learn we have collected or received personal data from a child under 16 without verification of parental consent, we will delete that information. Information We Collect and How We Collect It
We collect information from and about Users in various ways, including:
- Directly from you when you provide it to us, through the Service or otherwise, such as written correspondence to us
- Automatically when you use the Service
## **_Information You Provide to Us_**
We collect certain information that you share directly with us, some of which is information that identifies, references, or is reasonably capable of being associated with, a particular individual or device (“**personal data**”), such as:
- Details needed to register for the Service, such as name, email address, the name of your employer/company, telephone number, user ID, and password
- Payment information such as credit card, debit card, or bank account information
- Information you share when you report a problem with the Service, including records and copies of your correspondence
- Feedback you provide to us about the Service
Depending on how you use the Service and what features you utilize, we may also collect information you upload to the Service related to your source code.
You may decline to provide personal data to us, but doing so may prevent us from providing the Service or certain functionality to you.
## **_Automatic Information Collection_**
When you download, access, and use the Service, we use technology to automatically some type of information:
- _System Data_. In order to provide the Service to you, we generate and collect information generated by Users’ various systems and applications connected to the Service, including performance levels, telemetry data, source code analysis (if applicable) and network traffic data.
- _Usage Data_. When you access and use the Service, we may automatically collect certain details of your access to and use of the Service, including traffic data, audit logs, and other communication data and the resources that you access and use on or through the Service.
- _Device Information_. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
- _Location Information_. The Service does not collect real-time information about the location of your device.
If you do not want us to collect this information your choice is to not download, register for, or access the Service or the relevant features of the Service.

When you use the Service or its content, certain third parties may use automatic information collection technologies to collect information about you or your device, such as our payment processor. These third parties include:

## **_Tracking Technologies_**
- _Cookies_. We use cookies (small files placed on your device) to customize and improve your experience with the Service, secure the Service, and make enhancements to the Service. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device. However, if you select this setting, you may be unable to access certain parts of our Service.

Portions of the Service and our emails may contain small electronic files known as web beacons that permit the Company, for example, to count users who have visited those pages or opened an email and for other related Service statistics (for example, recording the popularity of certain Service content and verifying system and server integrity).

- Provide you with the Service and its contents, and any other information, products or services that you request from us

- To our subsidiaries and affiliates.
- To service providers and other third parties we use to support our business who process the data on our behalf, and who are bound by contractual obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by us about our Users is among the assets transferred.
- With your consent.
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- To enforce our rights arising from any contracts entered into between you and us, including the Services Agreement and for billing and collection.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our Users or others.
Your Data Rights
You have the right to:
- **Request access** to, **correct** or **delete** any personal data that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. - **Review** and **change** your personal data through your account profile on the Service.
- Remove and/or reject cookies from our Service with your browser settings. If you remove or reject our cookies, it could affect how the Service performs for you.
- **Object to** processing of your personal data, request us to **restrict processing** of your personal data, or request to have your personal data in a **portable format**. You may send us an email at <privacy@prequel.dev> to make such a request. We cannot delete your personal data except by also deleting your User account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
- To the extent we have collected and/or processed your personal data with your consent, you may **withdraw your consent** at any time.
- To **make a complaint** at any time to the data privacy authority in your jurisdiction. We would, however, appreciate the chance to deal with your concerns before you approach such authority so please contact us in the first instance.
Data Security
We have implemented reasonable measures designed to secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted through our Service. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
Changes to Our Privacy Policy
We may update our privacy policy from time to time. If we make material changes to how we treat our Users’ personal data, we will post the new privacy policy on this page with a notice that the privacy policy has been updated and notify you by an alert in-Service the first time you use the Service after we make the change.
The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
